Entry into force notes
This Interministerial Order enters into force on the day of its publication.
Resumen

This Interministerial Order, consisting of four Chapters and three Annexes, regulates the performance of agencies and entities of the Federal Public Administration involved in environmental licensing, referred to in art. 14 of Law No. 11.516 of 28 August 2007. In particular, it regulates the activities of the National Indigenous Foundation-FUNAI, the Palmares Cultural Foundation-FCP, the National Historical and Artistic Heritage Institute-IPHAN and the Ministry of Health, in charge of drafting an opinion in an environmental licensing process under federal jurisdiction, in charge of the Brazilian Institute for the Environment and Renewable Natural Resources-IBAMA. It prescribes environmental studies related to the location, installation, operation and expansion of an activity or enterprise, presented as a subsidy for the analysis of the required license, such as: environmental report, environmental control plan and project, preliminary environmental report, environmental diagnosis, management plan, degraded area recovery plan and preliminary risk analysis, etc. IBAMA, at the beginning of the environmental licensing procedure, in the FCA-Activity Characterization Sheet, must request information from the entrepreneur on possible interference in indigenous land, quilombola land, protected cultural assets and in risky or endemic areas or regions for malaria.
