Resumen

Regulations that regulate fishing by foreign crafts in fishing zones of Canada in the Atlantic (Part I) and the Pacific (Part II) Oceans. Part III contains provisions relative to enforcement, whereas Part IV contains general provisions. Subject to subsections (3) and (5), no person who is on board a foreign fishing vessel of a flag state set out in Schedule II shall fish for or catch and retain fish of a species set out in Schedule X in a stock area set out in column II of that Schedule during the close time set out in column III (reg. 5 of Part I). Regulation 5.1. specifies minimum sizes for swordfish, whereas section 6 specifies minimum weight of bigeye or yellowfin tuna. Subject to subsection 10(2), where a person is fishing for a species of fish in a stock area under the authority of a licence, that person shall not retain an incidental catch of a species of fish, other than a species set out in the licence, that exceeds a fishing quota as specified in regulation 9. Regulations 15 and 16 provide for areas where fishing is altogether prohibited or fishing for capelin, squid, silver hake or argentines is prohibited. Regulation 28 (Part II) introduces restrictions on the use of gear for fishing for pacific hake and prescribes gear for fishing for various species listed in Schedule 7. The master of a foreign fishing vessel in Canadian fisheries waters shall ensure at all times that a distance is maintained of at least 1/2 nautical mile between his vessel and any equipment and gear attached thereto and any set fishing gear that has been marked so as to be visible to persons on board vessels navigating in the vicinity (reg. 33 of Part IV).
