Entry into force notes
This Decree enters into force on the day of its publication.
Resumen

This Decree amends the procedures related to environmental liability and compensation regime under the environmental licensing jurisdiction of the State of São Paulo. Amendments deal with following issues: resources destined to nature conservation units established by the Union or by the Municipality, or destined to Private Reserves of the Natural Patrimony (RPPNs), by proving the deposit of the value of the environmental compensation linked to the Term of Commitment of Environmental Compensation (TCCA), under Federal Law 9.985 of 18 July 2000 and Federal Decree No. 4.340 of 22 August 2002; II - Release of the resources subject to the TCCA for transfer to the entity of the Federation or owner of the RPPN beneficiary of the environmental compensation, will depend on the consent of the Environmental Compensation Chamber (CCA) of the Secretariat of the Environment; Conclusion of an appropriate legal instrument between the entrepreneur and the Federal entity of the RPPN, for the specific purpose of applying environmental compensation resources.
