Decree No. 30 of 1970 of the Ministry of Agriculture and Nutrition on the management and hunting of wildlife.

Resumen

This Decree-law lays down provisions pursuant to the Forest and Wildlife Management Act No. VII of 1961. Its purposes are the development of useful wild animal stock (game), the control of harmful wild animals, game management planning and the regulation of hunting. Wildlife management and hunting can be practised only in territories declared as "hunting grounds". Section 2 deals with the exercise of hunting rights. The Ministry of Agriculture and Nutrition appoints a management organ for hunting grounds. Hunting rights can be licensed by the Ministry or by another authorized organ and the licensee may also be the National Association of Hungarian Hunters (MAVOSZ) or other hunting associations. The licensor is entitled to supervise the licensee and may withdraw the licence in cases specified under Article 4(2). Cooperatives whose territory covers at least two-thirds of the territory of a hunting ground can claim the transfer of hunting licence to the hunting association constituted by them. Article 6 provides for occasional hunting licences (in particular for non-Hungarian citizens). Section 3 deals with requirements for obtaining hunting rights (such as age, hunting ticket, citizenship, permit for shot-guns, etc.). Rules for obtaining hunting tickets are defined in Article 9. Section 4 deals with game management. In terms of application of the Forest and Wildlife Animal Management Act and of this Decree-law, wild animals are free, indigenous or migratory mammals or birds important to wildlife management. Useful wild animals which can be hunted: deer, fallow deer, roe-deer, moufflon, hare, pheasant, partridge, turtle-dove, ring-dove, snipe, mallard, teal, garganey, wigeon, bean goose and white-fronted goose. Protected useful species: bustard, hazel-grouse and quail. Species declared as protected cannot be considered harmful. Article 11(6) determines the sphere of large and small-size game, whether indigenous or migratory in Hungary. Articles 12 and 13 provide for long-term wildlife management plans which are to be prepared for ten year periods. Annual plans are to be prepared in conformity with long-term plans. Detailed rules on wildlife management are set forth in articles 14-22 dealing with the obligations of the licensee, hunting seasons, the naturalization of non-indigenous species, the introduction of fresh blood, disease prevention and treatment of sick animals, the transport of live and hunted wild animals, wild animal breeding plants, hunting in the territory of artificial fish-ponds, game books to be kept by the hunter, the register of hunted, captured and dead wild animals to be kept by the licensee, trophies and their adjudication, small wild animal protection against damages caused by agricultural activities. Hunting prohibitions are determined in article 23 concerning hunting gear, instruments and methods. Rules regarding professional hunters are set out in Section 5. Section 6 deals with the prevention of damages caused by wild animals and Section 7 lays down provisions for the indemnity procedures. Damage assessment is to be carried out by an expert. Decisions on indemnities are taken by the executive body of the municipal council. A wildlife management fund is established. The sources and use of its funds, governed by the Ministry of Agriculture and Nutrition, are specified in Article 34. The administration of wildlife management and hunting is carried out principally by the specialized county organ and in special cases by the Ministry. If the hunting ground is situated on the territory of more than one county, the competent county is that comprising the largest area. The National Association of Hungarian Hunters (MAVOSZ) is a common association of all hunting associations. The Decree repeals provisions regarding certain bird species (rook, starling, common heron and winter divers), contained in Annex 13 of Decree No. 43 of 1968 on Plant Protection.
