The Act came into force on 26 October 2002.

Resumen

This Act has been adopted in implementation of Directive 79/409/CEE, which sets forth bird protection measures to comply with. Nevertheless, according to article 9 of the mentioned Directive, Member States may derogate from the provisions of articles 5 to 8 establishing such measures for the following reasons: (a) in the interest of public health or safety, air safety, protection of fauna and flora; (b) to prevent serious damages to crops, livestock, forests, fisheries and water; (c) research and teaching; (d) repopulation or reintroduction of certain species. The present Act implements article 9 in matter of derogation from bird protection measures. The Act consists of only one article supplementing Act No. 157 of 11 February 1992. In particular, the Regions are hereby empowered to lay down the above-mentioned derogations in compliance with Directive 409/79/EEC and the present provisions. Every year, each Region shall transmit to the Prime Minister and to the Ministry of the Environment a report on the implementation of such derogations. Thereafter, the Ministry of the Environment shall submit the report to the European Commission.
