Abstract

This article discusses Brazil’s national implementation of the Stockholm Convention on Persistent Organic Pollutants (POPs), signed in 2001 and in force internationally and domestically since 2004. Domestic enactment of these international commitments has fallen short of conventionality. There are deficiencies in the drafting and discussion of official documents, due to the absence or weakness of public consultations. Discrepancies between the technical content of the Stockholm Convention and the guidelines and norms already published or under discussion reveal a clear inclination to minimize or avoid strict compliance with international rules. One major example is a loophole allowing POPs to be eliminated by methods such as incineration, which themselves produce POPs. The involvement of international organizations in cooperation projects to support such initiatives causes concern because of their explicit recommendation to alienate the participation of non-governmental organizations and social movements. Such non-compliance with the POPs Convention, in terms of processes and of domestic implementation, requires the adoption of urgent measures to change course and to undertake a full review of documents already produced and of others under preparation, in order to provide a successful example of institutional learning.
