It has effect subject to the obligations of Australia under international law, including obligations under any agreement between Australia and another country or countries. The 37 sections are divided into 4 Parts: Preliminary (I); Preservation, Conservation and protection of Whales (II); Administration (III); Miscellaneous (IV). With the agreement of the Governor of a State or of the Administrator of the Northern Territory, the regulations may declare the whole or a specified part of the coastal waters of that State or Territory, as the case may be, to be prescribed waters for the purposes of this Act. Section 9 prohibits killing, taking etc. of whales, certain exemptions are allowed by section 11.
