The Regulations shall apply to an area designated and declared to be a Water authority and to any other entity or person providing water supply and sanitation services such as a community organization. Subject to section 9 of the Act, the Minister may (a) declare an area specified in a notice (form prescribed in the First Schedule of these Regulations) as a water authority; and (b) cluster water authorities. Such area shall at minimum be a township, district headquarter, regional headquarter, national water scheme or a cluster of community organizations. Water Authorities shall be categorized by the Energy and Water Utilities Regulatory Authority (EWURA) according to their performance (there shall be a performance contract). A Water Authority shall obtain a licence from EWURA. A license issued by EWURA may either be of class I, II or III. Water authorities may be assisted by the Rural Water Supply and Sanitation Agency (RUWASA).
