Abstract

These regulations are made under sections 40 and 68(2) of the Water Industry (Scotland) Act 2002 (asp 3). Article 3 provides that persons (which includes individuals, companies, incorporated bodies and partnerships) shall be exempt from charges for water and sewerage services if the conditions in regulations 6 to 8 are fulfilled. The exemption applies from the financial year in which the statement and information provided for in regulation 8 are given to Scottish Water until 31 March 2006 (reg. 4). The exemption is lost if the statement or information is inaccurate or misleading.
