Abstract

These regulations amend the Waste Management (Landfill) Regulations ("the principal regulations")as follows: Sub-regulations (2) of Regulations 1 are substituted so as to better define the objective of the Regulations, which is supporting the European Union’s transition to a circular economy and meeting the requirements of Directive 2008/98/EC, particularly so as to ensure a progressive reduction of landfilling of waste and reduce negative effects on the environment. Also sub-regulations 3 is amended and sub-regulations 4, which is substituted to reflect the amendments in the European legislation as regards specific criteria for the storage of metallic mercury. Regulation 2 is amended so as to introduce some new definitions. Regulations 3 is also modified: in particular a sub-regulation 3 is added here in order to exclude the management of waste from land-based extractive industries from the scope of these regulations. Regulation 5 is also amended: a new sub-regulation 3 is added foreseeing, by 2035, the reduction of the amount of municipal waste landfilled to 10% or less of the total amount of municipal waste generated (by weight). A new sub-regulation 4 is also added to provide for the possibility to postpone the target referred to in sub-regulations 3. Rules on the calculation of the attainment of such targets are set out in a new regulation 5A. In regulation 6, among other, are revised the wastes that are not accepted in a landfill and a sub-regulations 2 is added which requires that the competent authority endeavours to ensure that, as of 2030, all waste suitable for recycling or other recovery, in particular municipal waste, shall not be accepted in a landfill (excepted the waste for which landfilling delivers the best environmental outcome). Further, regulations 10, 11, 12 and 14 are reworded and a new regulation 17A is added after regulation 17, referring to economic instruments and other measures to provide incentives for the application of the waste hierarchy under regulation 4A of the Waste Regulations. Also Schedules 1, 2 and 3 are amended.
