Abstract

These Regulations amend the Waste (England and Wales) Regulations 2011 so as to, among other things: add in regulation 29 a new list of “relevant offences” for the purposes of refusing registration of carriers, brokers and dealers of controlled waste; insert a new Part relating to the production of authority for transporting controlled waste (which is the certificate of registration) where this is required under section 5(2)(a) of the Control of Pollution (Amendment) Act 1989. The new Part (10A) consists of only one regulation (45A) which specifies how an authority to transport waste must be presented under section 5 of the Control of that Act on power to require production of authority, stop and search etc.
