This Regulation enters into force on the day of its publication.
Abstract

This Regulation, consisting of 33 sections divided into four Parts and completed by two Schedules, implements the Waste Avoidance and Resource Recovery Act 2007 by setting out procedures and requirements for applying for a waste collection permit and by providing for licence conditions. The Regulations further provide for material recovery facility operator who must not permit any container in respect of which the operator has made a claim for the payment of a processing refund to be disposed of to landfill. For the purposes of the definition of material recovery facility operator in section 20 of the Act, each of the following is prescribed as a class of material recovery facility operators: alternative waste treatment plant operators; bottle crushing service operators; Lord Howe Island waste facility operators. Bottle crushing machine is a machine designed to crush empty glass containers. The bottle crushing service operator is a person performing: a) supply to owners or operators of premises at which containers are sold of bottle crushing machines for permanent installation at the premises; b) collection and processing for reuse or recycling of the containers that are crushed by operation of those bottle crushing machines.
