Abstract This Regulation sets out rules regarding nutrition claims concerning food to be delivered to the final consumer in order to provide a high level of consumer protection. This Regulation lays down provisions on nutrition claims used in the labelling, presentation and advertising of food offered to the final consumer and mass caterers within the scope of information legislation. Article 5 underlines that the use of nutrition claims shall not: (I) be false, ambiguous or misleading; (II) give rise to doubt about the safety and/or the nutritional adequacy of other foods; (III) encourage or condone excess consumption of a food; (IV) state, suggest or imply that a balanced and varied diet cannot provide appropriate quantities of nutrients in general; and (V) refer to changes in bodily functions which could give rise to or exploit fear in the consumer, either textually or through pictorial, graphic or symbolic representations. This Regulation has been drafted in accordance with the Regulation (EC) No 1924/2006 of the European Parliament and of the Council of 20 December 2006 on nutrition and health claims made on foods.
