They also insert new Regulations 33A and 33B into the Town and Country Planning (Environmental Impact Assessment) Regulations 2017 to make provision where, in relation to Schedule 1 development or Schedule 2 development, a local planning 8 authority (under section 97 or 102 of, or paragraph 1 of Schedule 9, to the Town and Country Planning Act 1990) or the Secretary of State (under section 98(6), 103(2), 141(2), 100(1) or 104(1) of the Town and Country Planning Act 1990) proposes to grant or modify a planning permission.
