Abstract

This Law, consisting of 45 articles and divided into four Parts, concerns provisions for the control of the profession of pharmacy and the trade in drugs and poisons. In its consolidated version the Law achieves its purpose of harmonisation with Article 3 of the Commission's Executive Directive 2012/52/EU on measures to facilitate the recognition of medical prescriptions issued in other Member States, and with Directive 2013/55/EU of the European Parliament and of the Council on the recognition of professional qualifications. The following relevant terms are defined: authorised seller of poisons; dispensing, intended as supplying a drug or a poison by a duly qualified medical practitioner, dentist or veterinary surgeon; duly qualified; licensed seller of poisons; non-poisonous drug; pharmacist; veterinarian; veterinary surgeon; dosage of medicinal product; outpatient; health care service. The Law provides for: the appointment of Pharmacy and Poisons Board and the definition of its duties; matters concerning pharmacy, including: mandatory register of pharmacists, issuance of permits, qualifications of pharmacists, business and companies; matters concerning poisons, including: classification of certain drugs and pharmaceutical preparations as poisons, sale of defined poisons, labelling of poisons, supply of drugs, issuance of licences and permits; miscellaneous provisions, including: powers of entry and inspection, standard to which drugs must conform, medical prescriptions, power to make regulations, penalties.
