Abstract

With a view to preventing and remedying environmental damage, the present Act lays down provisions relating to environmental liability based on the “polluter pays” principle. The text consists of 18 articles as follows: Purpose (1); Sphere of application (2); Exceptions (3); Definition of terms (4), Preventive measures (5); Restoration activities (6); Fixation of restorative measures (7); Cost resulting from prevention and restoration activities (8); Competent authorities (9); Transboundary environmental damage (10); Environmental complaints and reclamations (11); Legal proceedings (12); Legal aid (13); References to other provisions (14); Penalties (15); Implementation of EU-directives (16); Transitional provisions (17); Entry into force (1). Four Annexes are enclosed.
