Abstract

This Regulation, as in accordance with the provisions of the Montenegrin Law on freshwater fisheries and aquaculture, determines the compensation amount for damage caused by fishing or other activities to fish and other aquatic organisms. Compensation fees for damage caused to fish and other aquatic organisms by conducting commercial and sport-recreational fishing, without a permit, divided by related species, are laid down in article 2; this text further sets such compensation rules and fees for catch of fish and other aquatic organisms below the prescribed minimum sizes; for fish and other aquatic organisms found to have died from the introduction or discharge of waste water, liquid or solid waste into fishing water, pumping fishing water or relocating flows; for fish and other aquatic organisms, which have been found to be caught in the manner and with the use of prohibited fishing gear and equipment and/or in periods with hunting season or fishing ban; for fish and other aquatic organisms, which have been found to be caught in the manner and with the use of prohibited fishing gear and equipment, electro devices, firearms, explosives, underwater rifles. However if the damage of a larger scale was caused in the manner referred to in articles 4, 5 and 6 of this Regulation, to juvenile fish, the compensation for damage shall be determined by the expert commission consisting of a representative: state administration body responsible for fisheries; Faculty of Natural Sciences and Mathematics - Department of Biology; users of fish and other aquatic organisms in whose territory the damage was caused.
