Abstract

The present Regulation, issued by the Ministry of Food, Agriculture and Fisheries, applies to the production and marketing of fruit plant propagation material and fruit plants within the European Union. The Regulation requires that suppliers of fruit plants or fruit plant propagation material be registered with the Danish Agricultural Agency. Propagation material and fruit plants may only be marketed if the following requirements are met: 1. The propagation material has been officially certified as "nuclear plants," "basic material," or "certified material," or it meets the conditions for qualification as CAC material; and 2. The fruit plants have been officially certified as certified material, or they meet the conditions for qualification as CAC material. Propagation material and fruit plants consisting of a genetically modified organism, as defined in Directive 2001/18/EC, may only be marketed if the genetically modified organism has been approved in accordance with that Directive or Regulation (EC) No. 1829/2003.
