Abstract

This Regulation prescribes: 1) the types of packaging and materials to which exceptions in relation to heavy metal content may be applied, as well as the time periods in which the relevant exceptions may be applied; 2) the percentage volume of all packaging waste and various types of packaging that is to be utilised for recovery, as well as the time periods in which the specified volume is to be recovered; 3) the volume of packaging waste utilised in one calendar year at the reaching of which a packer and a packaging management undertaking (company) have an obligation to register in the Ministry of Environmental Protection and Regional Development or an authorised authority thereof, to manage the packaging waste and provide a report on the volume and types of collection of packaging waste and resource recovery; 4) the procedures by which a report on the volume and types of packaging produced, exported or imported, and the volume and types of the collection of packaging waste and resource recovery shall be submitted, as well as the model form of the report. The total content of lead, cadmium, mercury and chromium (VI) (hereinafter – heavy metals) in glass packaging and packaging materials in the production process of which recyclable materials are added, but heavy metals are not utilised, may be up to 200 parts per million (ppm by weight), that is, up to 200 milligrams in one kilogram of packaging or the materials or components thereof.
