The present Regional Act, in compliance with Directive 85/337/EEC, determines the private and public projects which shall be subject to the previous performance of the Environmental Impact Assessment. The projects are listed out in article 4. The procedure to be followed shall encompass an assessment phase and a verification phase (art. 1). Both phases are fully described and regulated under Title II and Title III respectively. Article 2 defines the essential factors to be taken into account, namely human beings, fauna, flora, soil, water, air, climate, landscape and cultural heritage. The Regional Council is designed to be the competent authority in assessing whether the project in question is consistent with the environment or not. It shall rely on the advices given by the Regional Technical Committee for the Environment, which is set up by article 16. Title V lays down the penalties to be applied in case of infringement.
