Abstract

Article 37 bis, the text of which is contained in article 1 hereto, shall be inserted after article 37 of Regional Act No. 3 of 12 January 1994. This new provision is based upon article 9 of Directive 79/409/EEC, which allows Member States to derogate from the provisions of articles 5 to 8 of the same Directive, where there is no other satisfactory solution, for particular reasons, such as interests of public health and safety and the prevention of serious damage to crops, livestocks, fisheries and water. At the national level, these derogations shall be adopted by the Regional Council. However, no derogation may be adopted in respect of bird species at serious risk of extinction.
