Abstract

The Regional Act, consisting of eight Titles, protects fish species and regulates fisheries in the inland waters of Emilia-Romagna, with a view to safeguarding aquatic ecosystems and promoting the restoration of the ecological balance. The provisions shall apply to internal waters, including the maritime domain defined by Presidential Decree No. 1639 of 2 October 1968. The Region encourages the participation of recognized fisheries associations and environmentalist associations in the following activities: a) fisheries planning and management; b) monitoring functions pertaining to the Provinces; c) protection of water wholesomeness. To be recognized, the above-mentioned associations must be non profit organizations and meet the remaining requirements laid down in article 3, paragraph 3. The Act provides for the establishment of a Fisheries Regional Commission, which shall exercise advisory functions, and Fisheries Basin Commission (art. 4 and 5). If necessary, the Provinces shall provide for the creation of Commissions for the Management of Fishing Areas, too (art. 6). Title II concerns planning. The Region boosts the conservation, improvement and biological balance of fish species through the Regional Fishery Plan, which shall consist of the Fishing Basin Plans to be approved by the Provinces (art. 7). Hydrographical basins shall be demarcated by the Regional Council, in compliance with the criteria laid down in article 1 of Act No. 183 of 18 May 1989. Article 9 refers to the Regional Fisheries Chart describing the physical and biological characteristics of water courses as well as criteria intended to select fish species to be repopulated. Title III lays down rules intended for the conservation of fish species and of the environment. The Provinces, upon advice given by the Basin Fisheries Commissions, shall define Protected Fish Species Areas (art. 12). Such areas are intended to guarantee the natural reproduction of fish species. Fish species may be harvested on protected areas only upon authorization of the President of the competent Province (art. 12, par. 5). The introduction of non autochthonous fish species into internal waters is prohibited (art. 13). Title IV regulates fishing and lays down provisions in matter of fishing licence (art. 16, par. 2). The Regional Council shall determine permitted fishing hours, minimum size of fishes that may be harvested and related total allowable catch (art. 16, par.7). Title V regards the management of fish species and fisheries in reclamation waters. As referred to in article 18, the competent Provinces shall designate prohibited fishing water courses within sixty days from the entry into force of this Act. Article 21 lays down detailed provisions in matter of fishing licence, prohibited fishing areas, periods and hours during which fishing is forbidden. Title VI concerns activities related to fishing. Title VII sets out penalties.
