AN ACT To provide for the control and regulation of public procurement and the disposal of public assets so as to ensure that such procurement and disposal is effected in a manner that is transparent, fair, honest, cost-effective and competititve; to establish the Procurement Regulatory Authority of Zimbabwe and to provide for its functions; to amend the Infrastructure Development Bank of Zimbabwe Act [Chapter 24:14]; to repeal the Procurement Act [Chapter 22:14] (No. 2 of 1999); and to provide for matters connected with or incidental to the foregoing.

Abstract

The Act is meant to apply to all stages of the process of the procurement of goods, construction works and services by procuring entities and the disposal of public assets by procuring entities. Specifically, the Act does not apply to the procurement of services of fiscal agencies or depositary services, liquidation and management services for regulated financial institutions, services related to the sale, redemption and distribution of public debt and arbitration or conciliation services. The Act also does not apply to public employment contracts. The main objectives of the Act include to ensure that procurement is effected in a manner that is transparent, fair, honest, cost-effective and competitive; to promote competition among bidders; to provide for the fair and equitable treatment of all bidders, leading to procurement contracts that represent good value for money; to promote the integrity of, and fairness and public confidence in, procurement processes; and to secure the implementation of any environmental, social, economic and other policy that is authorized or required by any law to be taken into account by a procuring entity in procurement proceedings. The Act establishes the Procurement Regulatory Authority of Zimbabwe as a body corporate and charges it uphold the objectives of the Act. The Act places responsibility on each procuring entity to manage its procurement where the value of the procurement requirement is below the prescribed threshold. In some cases, the Act gives the procuring entity the responsibility to manage its procurement where the value of the procurement requirement is at or above the prescribed threshold. The Act mandates procurement entities to use only the standard bidding documents that are produced and issued by the Authority for the sake of procurements. The Act also provides for two methods of procurement, including competitive and restrictive bidding. Essentially, the Act provides that transparency and integrity shall be maintained throughout the procurement process.
