By-catch caught by a fishing vessel, either by purse seine or longline vessels may either be landed at a transshipment port in the Federated States of Micronesia in accordance with any regulation promulgated pursuant to this Act or recorded in the daily catch report form for the vessel and discarded. If sharks are caught alive they are to be released. The Act sets out various requirements for the handling of sharks and prohibits shark finning. It shall be a rebuttable presumption that any sharks caught or shark fins possessed by a fishing vessel fishing in the EEZ of the Federated States of Micronesia, originated from the EEZ of the Federated States of Micronesia.
