Abstract

The Decree aims at harmonizing the Greek legislative frame with the provisions of Directive 2004/35/CE as amended with article 15 (environmental liability) of Directive 2006/21/EC, so as to ensure that a framework of environmental liability based on the ‘polluter-pays' principle is established, to prevent and remedy environmental damage. The Decree, consisting of 3 Chapters, is composed as follows: objective (art. 2); definitions (environmental damage, conservation status in respect of a natural habitat, etc.) (art. 3); scope (art. 4); exceptions (art. 5); competent authority (art. 6); general frame regarding the liability of relevant operators (art. 7); preventive action on environmental damage (art. 8); remedial action on environmental damage (art. 9); determination of remedial measures (art. 10); prevention and remediation costs (art. 11); cost allocation in cases of multiple party causation (art. 12); request for action and review procedures (art. 13); financial security (art. 14); cooperation between other European states (art. 15); controls (art. 16); administrative sanctions (art. 17); legal protection (art. 18); temporal application (art. 19); reports and review (art. 20); annexes I-VI (art. 21); entry into force (arts. 22-23).
