Abstract This Act lays down rules for the agreement for forestry right on leased land or custom land; registration, transfer and variation of forestry rights; successorship, duration, renewal and cancellation of forestry right; permitted activities and proceeds of forest products; mortgage of registered forestry right; establishment of registry of forestry rights and planted forest database; sale and export of forestry products; reforestation and carbon ownership; compliance with and matters regulated by the Planted Forest Harvesting Code; assessments and valuation of a planted forest subject to forestry right; and offences and penalties. For the purposes of protection of environment, the Planted Forest Harvesting Code may regulate matters such as a harvesting plan; works ancillary to a harvesting operation; soil erosion and sediment control; native animals and plants; post- harvest bush fire hazard reduction burning; indigenous relics and cultural or historic sites; and the protection of unique or special animals or plants. If there is any inconsistency between this Act and the Forestry Act [CAP 276] in respect to forestry rights, this Act shall prevail. The Minister may make regulations prescribing all matters required or permitted by this Act to be prescribed or necessary or convenient to be provided for the carrying out or giving effect to this Act.
