Abstract

These Regulations amend the Plant Varieties (Proprietary Rights) Regulations, 1981 by placing new species under the working of section 4 of the Plant Varieties (Proprietary Rights) Act, 1980 and thus extend protection provided for in that section to these species. The Regulations also prescribe genera and species mentioned in column (2) of the Schedule for the purposes of section 12 of the Act and prescribe that the maximum period for which plant breeders' rights are exercisable in respect of a plant variety which is of a such genus or species shall be the period of 20 years.
