Entry into force notes
The text enters into force from the day of its promulgation in the "State Gazette", with the exception of § 1, item 1, item 3, letter "b", items 4 - 7, items 9 - 18, § 2, item 6, letter "b", sub-letter "bb", item 7, item 10, letters "d" and "e", items 11 – 17, § 3, items 1, 2 and item 5, letter "b", which enter into force on August 28, 2019.
Abstract

This Ordinance lays down terms and procedures for making environmental impact assessments of investment proposals. The competent authority shall approve the implementation of the investment proposal if the plan for implementation of measures for prevention, reduction or liquidation of substantial negative impacts ensures compliance with the norms for quality of the environment. The Ordinance also establishes that the Ministry of Environment and Water shall be the competent authority for environmental impact assessments for investment proposals with transboundary impact. Environmental impact assessment is carried out in the following sequence: 1. notification of the competent authorities and the affected population; 2. assessing the need for an EIA; 3. carrying out consultations; determining the scope, content and format of the EIA report; 4. assessing the quality of the EIA report; 5. organizing a public discussion of the EIA report; 6. EIA decision-making; 7. carrying out control over the implementation of the conditions and measures of the EIA decision or the decision to assess the need for EIA. For cases of investment proposals with cross-border impact, the requirements of Chapter Eight shall apply.
