Abstract

This Regulation sets rules on penalty enforcement of commercial entities trading in novel foods and novel food ingredients, in accordance to EU provisions. Unless a higher penalty is given under other legislation, violations of articles 3.1, 3.2 on the marketing of novel foods without authorization, and art. 8.1. are subject to punishment in form of a fine, in adherence to Regulation (EC) No. 258/97. Penalties may increase to imprisonment up to two years for offenses committed with intent or gross negligence, such as causing damage to health, achieving financial gain for oneself.
