Abstract This Order sets regulations on trade, distribution and financing of planting seed varieties as listed in Appendix 2 and which provisions require registration through the CPVO – the entrusted Danish examination authorities. A batch of planting seed mixtures must be registered for certification officially marked labelling to enable inspection for compliance with standards set in Appendix 3 and 5 on the variety and content of seed species. The notification must be submitted in writing to the Tystofte Foundation and only submitted by a registered commercial company; it must indicate under which category the batch is required to be certified, from which farm or certified parties it is originating and in which amounts. These sorts must come from a EU Member State as (1) pre-basic or certified seeds certified in a EU Member State or from a non- EU Member State which production of seeds is approved as equally to that of a Member State; and as (2) a crossing of basic seed certified in a Member State (hybrid variety). A batch of seeds may be traded until the end of the season which goes from 1 July to 30 June in order to investigate norms for germination in compliance with Appendix 5. The Tystofte Foundation shall certify a batch of seeds in accordance to certification rules for seeds internationally traded and laid down by the Organisation for European Economic Co-operation (OECD). Provisions in article 25 apply to seeds of the species Helianthus annuus L. (sunflower), although not included in this Order.
