Abstract

These Regulations of the Minister of Environmental Affairs, made under sections 48A and 86 of the National Environmental Management: Protected Areas Act, 2003, provides rules for the administration, conservation and management of the Agulhas Front Marine Protected Area. The Marine Protected Area is entirely zoned as one Restricted zone in terms of the Act. In such zone no fishing may take place, but where any other activity in terms of section 48A(1) of the Act may take place if authorised in terms of these Regulations as contemplated in terms of section 48A(2) of the Act. Section 48 was inserted into the principal Act by the National Environmental Management: Protected Areas Amendment Act 2014. The Regulations set out general restrictions within the Marine Protected Area. Fishing gear onboard a vessel or in possession of any person that enters or is present in the Marine Protected Area must be stowed in the prescribed manner. A permit issued in terms of these Regulations may be suspended, cancelled or amended.
