Abstract

These Regulations of the Minister of Environmental Affairs, made under sections 48A and 86 of the National Environmental Management: Protected Areas Act, 2003, provides rules for the administration, conservation and management of the Agulhas Bank Marine Protected Area. The Marine Protected Area comprises a Restricted Zones, a Controlled Zone and a Controlled-Pelagic Linefish Zone in terms of the Act. No person may undertake any activity listed in section 48A(1) of the Act in the Marine Protected Area unless authorised to do so in terms of these regulations. Section 48 was inserted into the principal Act by the National Environmental Management: Protected Areas Amendment Act 2014. The Regulations set out general restrictions within the Marine Protected Area. No fishing may take place in the Restricted Zone. For fishing in the Controlled zone or Controlled Pelagic Linefish Zone a valid fishing permit is required. Various limitations are placed on such fisheries. A permit issued in terms of these Regulations may be suspended, cancelled or amended.
