Abstract

These Regulations are made by the Minister of Environment pursuant to the provisions of section 34 of the National Environmental Standards and Regulations Enforcement Agency (Establishment) Act, 2007. They are meant to prevent and minimize the destruction of the ecosystem through fire outbreaks and burning of any material that may affect the health of the ecosystem through the emission of hazardous air pollutants. The Regulations provide that a person shall not burn, cause, or permit any combustible material in an open fire without a permit from NESREA; it provides the way and manner plant waste is to be burned. The Regulations also provide extensively for practices which may lead to forest/bush fires and advances ways to mitigate the fires, for instance it provides for safety precautions in the use of farm machinery, the installation of fire extinguishers in farms, the use of explosives, use of Bee Smoker devices, prohibition of burning forests for hunting of animals, among others. Offences are provided for the violation of the provisions of the Regulations and penalties are fines and prison terms.
