Abstract

The purpose of this Decree is to approximate the Greek legislative frame with Council Directive 88/379/EEC as regards the classification, packaging and labelling of preparations dangerous to man and the environment when they are placed on the market. Also, the Decree aims at adapting to technical progress regarding this subject, according to the provisions of Council Directive 88/379/EEC. The provisions of the Decree shall apply to preparations which are placed on the market and which contain at least one substance classified as dangerous, within the meaning of article 2 and 3, and to the preparations listed in Annex II. The classification of dangerous preparations according to the degree of hazard and the specific nature of the risks involved shall be based on the definitions laid down in article 2. The preparations shall be classified according to the greatest degree of hazard in accordance with article 7. The preparations envisaged by this Decree cannot be placed on the market unless they comply with the packaging and labelling requirements set forth in Presidential Order No. 329/83 and in the present Decree. This Decree shall not apply to medicinal or veterinary products, cosmetic products, mixtures of substances which, in the form of waste, are covered by Directives 75/442/EEC and 78/319/EEC, pesticides covered by Directive 78/631/EEC and 83/291/EEC, foodstuffs and animal feedingstuffs in a finished stage intended for the final consumer, preparations in transit which are under customs supervision provided they do not undergo any treatment or processing. The general principles of the classification and labelling of preparations shall be applied according to the criteria in Annex VI to Presidential Order No. 329/83, save where alternative criteria referred to the present Decree are applied. Also, the requisite physico-chemical properties for the classification of preparations shall be determined by the methods specified in Annex V, point (A) to Presidential Order No. 329/83.
