Abstract

These Regulations, made by the Minister responsible for Maritime Administration, in exercise of the power conferred by section 122 of the Merchant Shipping Act 2002, provide for the control disposal of garbage and discharge of sewage from marine ships. A “discharge” does not include dumping within the meaning of the Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter. Regulation 6 sets out to which ships specific provisions of these Regulations apply. They also apply in part to platforms and apply restrictions on Bermuda ships entering the Antarctic area. The Regulations implement the International Convention for the Prevention of Pollution from Ships 1973 (including its protocols, annexes and appendices thereto) as amended by the Protocols of 1978 and 1997. The Convention includes— all the amendments to that Convention adopted by the Marine Environment Protection Committee of the IMO before the date on which these Regulations are made; and any subsequent amendment to that Convention which is considered by the Minister to be relevant from time to time. Implementation concerns, among other things, certification of ships, garbage management plns, record keeping and restrictions applying to Special Areas.
