Abstract

These Regulations amend the Merchant Shipping (Prevention of Oil Pollution) Regulations 2010 regarding the exceptions for damage to a ship or its equipment in internal or territorial waters from rules regarding discharge of oil if the discharge was caused by damage to the ship and it was not the result of intentional, negligent or reckless behaviour and all reasonable precautions were taken after the damage, or discovery of the discharge, to prevent or minimise the discharge. These Regulations also insert a new regulation (35A) on powers of harbour masters on the detainment of ships and a regulation (36A) on penalties for offences.
