Abstract

These Regulations, made by the Minister responsible for Maritime Administration, in exercise of the power conferred by sections 3, 93 and 94 of the Merchant Shipping Act 2002, provide for the control by port authorities of Bermuda of foreign ships and their activities as covered by various specified Conventions. They implement IMO Resolution A. 1119(30) on port state control. The list of Conventions includes, among other things, MARPOL, the International Convention on Civil Liability for Oil Pollution Damage, 1992 and SOLAS. The Regulations shall not apply to fishing vessels. Bermuda will in each calendar year ensure the carrying out of inspections on 15 per cent of the definitive number of vessels visiting Bermuda which are subject to these Regulations. An inspection may be an initial inspection, a more detailed inspection, or an expanded inspection. A record of inspections conducted in Bermuda will be maintained by the Bermuda Shipping and Maritime Authority.
