Abstract

These Regulations, made under the Merchant Shipping Act, 2002, set out procedures for port state control of foreign ships in ports of Saint Christopher and Nevis or at offshore installations for purposes of various listed Conventions including MARPOL. The Department of Maritime Affairs is designated as the competent authority for purposes of port inspections. The Regulations set out the procedures of such inspections, specify criteria for the detention of a vessel and provide for arbitration in case a master of a vessel disagrees with a decision of an inspector. The Regulations shall not apply to fishing vessels.
