Section 6(x) regarding the general powers of the Minister is amended. The title of Part III is amended as powers of the Minister and functions of the Department and 7A Functions of the Department in relation to maritime regulation and safety is inserted, including the registration of vessels and the maintenance of registers of vessels, the inspection and survey of vessels, the regulation of small craft, vessel reporting and tracking control systems, marine pollution prevention and response, all aspects of flag state control over vessels entitled to fly the Kiribati flag, and all aspects of port state control over vessels within the jurisdiction of Kiribati. Section 9 on wrongfully using National Flag or claiming the national character of Kiribati is amended and the penalties are updated. Furthermore, this Act amends Section 16 on the Registrar of vessels and appointment of registry administrator, Section 17 on register of Domestic Vessels, and inserts Section 17B on register of foreign vessels. Section 42 regarding the appointment of authorized agent is repealed and therefore the words "authorized agent" are replaced with the words "administrator of the Register of Foreign Vessels" wherever they appear. Section 50 on requirements before registration of foreign vessels is amended by updating the list of prohibited activities of vessels that apply for registration. Moreover, this Act amends the Section 99 on international maritime conventions applicable to registered vessels and inserts Section 99B on vessels to comply with convention obligations and requirements and Section 99C on regulations to apply and enforce international maritime conventions. Section 139 is amended regarding the functions and duties of the Registrar of Seafarers. Section 267 on approved rules and standards etc., Section 268 on approved forms and fees, Section 269 on general offence against this Act and Regulations, and Section 270 on immunities are amended. This Act inserts Section 271 on extra-territoriality of offences against this Act. Schedule 1 listing the international conventions enforceable under this Act is amended and set out in this Act.
