This Act shall apply to any vessel, aircraft or platform owned or partly owned or chartered or otherwise operated by the National Government or any Provincial Government within or beyond all Papua New Guinea waters. This Act shall not apply to the disposal or storage of wastes or other matter directly arising from, or related to the exploration, exploitation and associated off-shore processing of seabed mineral resources. According to this Act, the incineration of wastes or other matters at sea and the loading of wastes or other matter onto a vessel or platform for the purposes of incineration at sea are prohibited. The dumping of wastes or other matters is also prohibited, with an exception of sea dumping permit for the wastes and other matters specified in Section 7. Furthermore, this Act sets forth provisions on application assessment fee for sea dumping permit, application evaluation, grant or refusal of permit, permit variations, suspension and revocation of permit, responsibility of the National Maritime Safety Authority for the enforcement of this Act, appointment and duties of the Inspectors, and offences and penalties.
