Abstract

This Order confers on the Department of the Environment, as an enforcement authority under section 114(2) of the Marine and Coastal Access Act 2009, powers to impose fixed monetary penalties and variable monetary penalties in relation to certain offences under section 85(1) of the Act (breach of requirement for, or conditions of, a licence). The Order also, among other things sets out requirements relating to enforcement action.
