Legislative Decree No. 93 implementing EEC Directives No. 90/675/CEE and No. 91/496/CEE on veterinary checks on products and animals originating from third countries and introduced into the European Community.

Abstract

The Decree states the checks to be carried out on the animals at the custom check points regarding the origin and destination of the animal and the verification of the sanitary certificates. The veterinarian authorized by the Government shall carry out diagnostic tests, laboratory tests, taking of samples, and shall evaluate the compliance with the provisions made by Legislative Decree No. 532 of 30 December 1992, regarding the protection of animals during international transports. The introduction of the animals is prohibited when: (a) the animal is imported from a country not included in the approved list; (b) the requisites established by the legislation of the country of destination are not satisfied; (c) the animals are, or suspected to be, affected by a contagious disease; (d) the exporter third country has not observed the Community legislation; (e) the animal should be detained at the custom check point; (f) the sanitary certificate is not in compliance with the Community legislation. Articles 7 and 8 concern the issue of a certificate and the checks to be performed on the animals listed in Legislative Decree No. 28 of 30 January 1993. The Decree establishes also all the conditions for the transit of the animals in the national territory (i.e. the authorization by the appropriate authority of the country of origin, the compliance with the provisions of the Presidential Decree No. 624 of 1982, in matter of animal transport, etc.). The enforcement of quarantine measures or the isolation of live infected animals (except for the foot-and-mouth disease, rabies and Newcastle disease, which are regulated by different provisions) shall be carried out either at quarantine stations recognized by the European Community, or at a quarantine station satisfying the requirements established in Annex B of this Decree or in the establishment of destination. The provisions regarding the imports of animals intended for slaughter or breeding animals (inspections, marking, sanitary checks, etc.) shall be adopted by decree of the Ministry of Health. Similar provisions are established for the import of products listed in Annex A, part 1 of Legislative Decree No. 28 of 30 January 1993. The Decree states also the measures to be taken in case of contravention and the relevant penalties to be inflicted.
