The Legislative Decree is divided into four Titles. Title II regulates the deliberate release into the environment of GMOs for research and development purposes or for any other purpose than for placing on the market. Article 5 gives particular regard to the notification to be submitted to the Ministry of Health and to the Ministry of the Environment before undertaking said deliberate release. Annexes II and III fully specify the information to be provided by such notification. Title III lays down provisions on the placing on the market of products containing GMOs. Such products may be marketed only if: a) consent has been given to the notification or a risk analysis has been performed; b) the products comply with the relevant Community legislation; c) the products comply with the requirements established by Title III concerning the assessment of the environmental risk. In case adverse effects on the environment or on human health are suspected, the Ministry of the Environment and the Ministry of Health shall respectively adopt the necessary ordinances prohibiting or restricting the use or the marketing of the products concerned. Articles 22-24 establish penalties. This Legislative Decree shall not apply to organisms obtained through the techniques of genetic modification listed in Annex I B.
