Abstract This Legislative Decree aims at achieving the objectives of article 2 of Legislative Decree No. 22 of 5 February 1997. To this end, it establishes technical requirements applicable to landfills of waste, procedures and guidance with a view to preventing and reducing negative effects on the environment and on the global environment (including greenhouse effect) as well as those risks to human health that might result from landfilling of waste. Particular attention is paid to the prevention of the pollution of surface water, groundwater, air and soil. Article 2 lays down several definitions in order to clearly determine the application scope. Landfills are to be classified into the following three categories: (a) landfill for inert waste; (b) landfill for non-hazardous waste; (c) landfill for hazardous waste. Within one year from the entry into force of this Legislative Decree, the Regions shall adopt special programmes for the reduction of biodegradable waste (art. 5). Article 6 specifies the waste that is not to be accepted on landfills. Article 8 regards the authorization which is required to operate a landfill of waste. The authorization may be issued if the conditions prescribed by article 9 are fulfilled. Article 16 lays down penalties. Annex 1 lays down general criteria for the construction and operation of landfills of waste. Annex 2 lays down principles and rules on the operation, management and environmental restoration procedures and after-case phases.
