Abstract

The flora conditions human and animal vitality on the Earth. Flora is a national wealth and one of the most important preconditions for wellness, social and economic sustainable development of the Earth. The law on Flora defines the State policy of the Republic of Armenia on scientifically motivated protection, maintenance, reproduction and use of natural flora. The document consists of 9 chapters that contain 33 articles. Chapter 1 (arts. 1-4) lays down general provisions. Chapter 2 (arts. 5-8) regards state regulation on protection, use and reproduction of the flora. Chapter 3 (arts. 9-14) regards research. Chapter 4 (arts. 15-19) regards conservation and protection of flora. Chapter 5 (arts. 20-29) regards management of flora species. Chapter 6 (art. 30) establishes rights and duties of the authorized institution that controls the implementation of the legislation on flora. Chapter 7 (art. 31) establishes liability for the infringement of the legislation on flora. Chapter 8 (art. 32) establishes international liability. Chapter 9 (art. 33) lays down transitional provisions. Article 5 establishes the competences of the Government of the Republic of Armenia in the field of protection, protection, use and reproduction of flora as follows: (a) implementation of the state policy of conservation, protection, use and reproduction of flora; (b) approval of state programs in the field of conservation, protection, use and reproduction of plant resources; (c) defining the order of protection and use of flora species; (d) approval of the list of plant authorized for use as plant resources, the amount of the fee and the order of collection thereof; (e) defining the order of organization and implementation of flora monitoring; (f) definition of the procedure for managing the flora register; (g) definition of the procedure for providing data of the state register of flora; (h) approval of the Red Book of plants and the list of plants registered in it; (i) implementation of international cooperation; (j) other powers defined by the legislation of the Republic of Armenia; and (k) defining the requirements for the size and species composition of the green zones of settlements. State programs are implemented through annual programs. The government submits the annual plan to the National Assembly as part of the draft state budget, the amount of which is reflected in the state budget expenditures. Article 24 establishes that the use of plants registered in the Red Book of the Republic of Armenia is allowed in exceptional cases for the purposes of scientific research, investment in cultivation and their reproduction under natural conditions, with the permission of the authorized state body in the field of protection, use and reproduction of flora, in accordance with the procedure established by the Government of the Republic of Armenia.
