Abstract

This Law establishes the procedure for supervision over activities related to the cultivation of hemp grown for the production of hemp fiber products, marketing thereof, import and licensing of import of hemp fiber products. This Law shall not be applicable to hemp products from the Republic of Lithuania defined in the Pharmaceutical Act as pharmaceutical products. The cultivation of hemp grown for fiber shall be supervised by the State Crop Service. This Law establishes the procedure for the supervision and control of the activities related to the production of fiber cannabis, the supervision and licensing of hemp products from third countries in the Republic of Lithuania. To the purpose of this Law hemp (Cannabaceae) shall be considered family of true hemp (Cannabis sativa L.) varieties grown kind of dried substance tetrahydrocannabinol is not more than 0.2 per cent, which is grown exclusively for industrial purposes (fiber and seed) or horticultural purposes. Production of fiber hemp shall be supervised by the State Plant Protection Service under the Ministry of Agriculture. Hemp seeds growers must: (a) grow fiber beet only in open ground; (b) cultivate only authorized varieties of crop plants, using only certified seed of oil and fiber plants certified by the Minister of Agriculture, which complies with the mandatory quality requirements for hemp seed; (c) provide information to the authorized institution on the planned production of hemp, approved by the Minister of Agriculture, in accordance with the procedure established by the Minister of Agriculture, by planting areas and informing about flowering of hemp fibers; (d) declare areas of hemp grown for fiber in the procedure for declaration of agricultural land established by the Minister of Agriculture; (e) keep the produce in the declared warehouses, in storage facilities, or leave the crop uncut in winter, to inform the State Plant Protection Service accordingly; (f) submit reports on quantities of hemp grown or sold to the Authority in accordance with the Description of the Maintenance Procedure; (g) submit to the authorized institution information on the use of hemp seeds used for sowing and not intended for sowing; and (h) comply with the provisions of this Law and its implementing legislation regarding the requirements for growing fiber beet. Only hemp and its derivates, including hemp seeds, complying with the provisions of this Law shall be authorized for trade and must be accompanied by label on packaging indicating the member state of the European Union as place of origin, or by certificate indicating exporting country. Only authorized importers can trade hemp and hemp seeds.
