The Law enters into force on the date of its official publication.
Abstract

This Law establishes legal, economic and organizational grounds for plant protection. Plant protection shall be carried out by means of: (a) state programmes for the prevention and liquidation of pests; (b) scientific research; (c) vocational training of specialists; (d) enforcement of the legislation on plant protection; (e) setting up reserve stock of insecticides, fungicidal agents and herbicides; and (f) phytosanitary monitoring. The Act consists of seven Sections divided into 18 articles: (1) general provisions; (2) competence of the Ministry of Agriculture and Food Industry in the sphere of plant protection; (3) State Plant Protection Service; (4) plant protection means; (5) duties and liability; (6) compensation and dispute settlement; and (7) conclusive provisions. Legislation on plant protection shall regulate relations between the state and economic entities in the sphere of plant protection with a view of preventing the propagation of pests, diseases and weeds. The Ministry of Agriculture and Food Industry shall have the following competence: (a) to carry out common state policy in the sphere of plant protection; (b) to prevent the outbreak of pests, diseases and weeds; (c) to guide the activity of State Plant Protection Service; (d) to test, approve and register plant protection means; and (e) to carry out international cooperation. Only certified plant protection means recorded in the National Register shall be authorized for use on the national territory. Landowners and other economic entities shall have the following duties: (a) to carry on inspection of agricultural land and forests for identification of pests; (b) to carry out plant protection arrangements following the recommendations of State Plant Protection Service; (c) to observe rules and regulations regarding, import, transport, storage and trade of plant protection means; and (d) to submit information of phytosanitary conditions of agricultural land.
