Abstract This Code regulates national maritime spaces, as well as situations and legal relationships arising from maritime navigation. Without prejudice to the provisions of each of its Books, and to international law rules binding the State of Cape Verde, the provisions of this Code apply to any ship, whatever its nationality or the nationality and residence of its owners or shipowners. The above mentioned provisions do not affect the powers of other flag States or other port States other than Cape Verde, in accordance with current international conventions, as well as the provisions of Title VII of Book II for foreign State ships. National ships are subject to the provisions of this Code wherever they are, without prejudice to the powers of other coastal States or ports arising from international law. Recreational navigation and its regime are subject to special legislation, without prejudice to the subsidiary application of the provisions of this Code, insofar as these are in accordance with the nature of its activities.
