This Governmental Decree enters into force on 26 March 2011.
Abstract

This Governmental Decree establishes the procedure for the use of unusable pesticides that do not comply with mandatory requirements related to registration, re-packaging, transportation, identification (labelling) and unsuitable for long-term storage. The rules for the use of unusable pesticides: unsuitable pesticides accounting, inventory, identification, packaging, storage, transportation and clearance requirements. Unusable pesticides shall be intended those with the expired storage period and incorrect conservation and also hazardous pesticide waste unsuitable for application. Unusable pesticides shall be subject to mandatory accounting, inventory and registration with a view of determination of quality, quantity and flow thereof. The following data related to unusable pesticides must be reported: (a) technical conditions; and (b) quantitative data distributed by groups: 1) labelled in intact package; 2) without label nor marking in intact package; 3) labelled in damaged package; 4) without label nor marking in damaged package; and 5) stored without package; and (c) toxicity and combustibleness. Disposable pesticides shall be subject to recycling. Unusable and unfit for recycling pesticides shall be subject to packaging in special containers for long-term storage in safe packages, for the period of at least 25 years, in order to prevent damages to human life and environment. The aforesaid containers must exclude leakage and (or) decomposition in the surrounding environment. All unusable pesticides are subject to re-packaging irrespectively of the integrity of original packaging. All containers must be labelled indicating container code, type of package and net weight of unusable pesticides.
