Abstract

The Law prescribes that any person who desires to engage in fishing in the "jurisdictional water" of Korea is obliged to obtain a permit from the Minister of Maritime Affairs and Fisheries (art. 2). "Jurisdictional water" for purposes of conservation of fishery resources is defined in article 1 as marine waters surrounding the Korean Peninsula and the islands annexed thereto, and enclosed by the boundaries created by connecting the boundaries set out in the same article. Any person who violates the provisions of this Act shall be liable to imprisonment or imprisonment without prison labor for not more than three years or a fine of not more than five hundred thousand Hwan, and the fishing boats, fishing gears, catch, cultivations and its products owned or carried by him shall be confiscated. A vessel passing through the jurisdictional waters which is suspected of having violated article 2, may be compelled to stop for inspection, searching or other necessary measures (art. 4).
